Terms of Use & Subscriptions
Updated
These terms describe Mindaily’s service and subscriptions. The app license is governed by Apple’s Standard End User License Agreement (EULA); these service terms do not replace it or limit mandatory consumer rights.

1. The service and provider
Mindaily is developed and operated by an individual developer using the FixMind name. Support and service questions: hello.fixmind@outlook.com. Mindaily provides short cognitive exercises for personal practice. Review these terms before using the service and the purchase information before subscribing.
Minors may use Mindaily. If you are a minor, review these terms with your parent or guardian and obtain any permission required by applicable law for use and purchases. If you cannot legally accept these terms yourself, a parent or guardian must accept them on your behalf where permitted by law. Apple’s content age rating does not establish contractual capacity or replace any required parental consent.
The developer operates Mindaily and handles support requests in China. The developer is also the contact for privacy requests and complaints at hello.fixmind@outlook.com.
2. What exercises and results mean
Mindaily is for education and general wellbeing. It is not medical advice, diagnosis, treatment or an emergency service. Scores describe performance on an exercise; they are not an IQ score, brain age or clinical assessment.
We do not promise improvements in health, intelligence, school/work performance or a specific cognitive outcome. Do not use results to make medical decisions or delay professional care. Take breaks and stop if an exercise causes discomfort.
3. Trial experience and paid access
The introductory exercise experience is separate from an Apple subscription free trial. Trying introductory exercises does not itself start a subscription. Ongoing access to the paid training service requires a valid Mindaily Plus subscription after that experience.
Monthly and annual plans provide the same paid access for different billing periods. A subscription does not create a FixMind web account or provide memberships in other FixMind products. Availability and eligible offers depend on the App Store region and Apple account.
4. Prices, payment and renewal
The price, currency, billing period and eligible introductory offer shown before confirmation in Apple’s purchase sheet govern your purchase. An annual price is charged as one annual amount, even if a monthly equivalent is displayed for comparison. Payment is charged through your Apple Account.
Subscriptions renew automatically unless cancelled. Apple may charge renewal within 24 hours before the current period ends. Cancel at least 24 hours before renewal or the trial end to avoid the next charge. Price changes and any required notices or consent are handled through Apple’s applicable process; we do not promise a fixed lifetime price.
5. Subscription free trials
A free trial is available only when Apple confirms eligibility and it appears in the purchase sheet. When offered, the annual introductory trial lasts 7 days; the monthly plan has no launch free trial. Apple’s displayed offer takes precedence if offers change.
If you do not cancel in time, the trial converts to the paid subscription at the disclosed price and period. Cancelling a trial may end access immediately under Apple’s rules. An unused introductory period may be forfeited when switching or purchasing as described by Apple. Reinstalling the app does not reset eligibility.
6. Cancellation, refunds and restoring purchases
Manage or cancel in iOS Settings → your name → Subscriptions → Mindaily, or use Manage subscription in the app. Deleting Mindaily, clearing data or emailing us does not cancel renewal. Cancellation normally stops future renewals; paid access continues until the entitlement expires unless Apple revokes it or a refund ends it.
For an Apple-billed refund, use reportaproblem.apple.com. Eligibility and processing follow Apple’s rules and applicable law; we do not promise approval or automatic pro-rata refunds. Your statutory remedies and consumer rights remain available.
Use Restore Purchases with the Apple Account used to buy the subscription. Restoration checks existing rights; it does not create a new charge, guarantee eligibility, or restore local training history. Purchases pending approval do not unlock paid access until Apple verifies them. Billing issues, expiry or refunds may end access.
7. Local data and backups
Mindaily has no Mindaily/FixMind login or app-operated cloud sync. Training information is local to your device, subject to device backups you configure. We cannot recover a lost local history from our servers.
Portable backups are unencrypted JSON files and contain only the sections described in the Privacy Policy. Restoring replaces supported local sections; it does not restore subscriptions, detailed results or interrupted sessions. Keep copies securely and review the restore confirmation. This does not limit any remedy you have for a defect in the app.
8. License and acceptable use
Apple’s Standard EULA governs the license, permitted devices and Apple-specific terms. The app, artwork and exercise content remain protected by intellectual-property law. Third-party and open-source components retain their own license terms, available in the app’s license notices.
Do not unlawfully redistribute protected content, bypass payment or security controls, or interfere with the service. Restrictions do not prohibit activity that applicable law or an open-source license expressly permits.
9. Updates, interruptions and service changes
Features may evolve, and technical interruptions can occur. We will provide notices and remedies required by law for material changes, discontinuation or failure to supply a paid service. These terms do not authorise removing your paid rights without applicable notice or remedy.
We may take proportionate steps to address unlawful or abusive use, subject to applicable law. You may stop using the app at any time; cancel your Apple subscription separately if you want renewal to stop.
10. Consumer rights and disputes
Nothing here excludes rights or liabilities that cannot lawfully be excluded, including mandatory consumer guarantees, statutory refunds, or liability for fraud or other non-excludable harm. Any warranty/liability provisions in Apple’s EULA remain subject to those rights.
Contact us first if you want help resolving a problem. These service terms impose no additional compulsory arbitration, class-action waiver or exclusive foreign court. Applicable law and Apple’s EULA govern where relevant, without depriving you of mandatory protections or courts available under local law.
11. Privacy, changes and contact
The Mindaily Privacy Policy explains local data, optional sharing and your choices. We date revisions to these terms and provide notice of material changes where required; changes do not retroactively remove accrued rights. Translations are intended to have the same meaning, subject to mandatory local protections. Contact hello.fixmind@outlook.com for help.
